The Ministry of Economy of Ukraine has proposed a draft of the new Labor Code for 2025, which discusses the monitoring of employee work correspondence and other data. According to TSN, this information is reported by Kontrakty.UA.
This is addressed in the draft of the new Labor Code.
"Monitoring of employee work correspondence and other data" is the title of a section in the document, specifically Article 31. According to its text, employers are now granted the right to review correspondence and documents used during the workday.
"Employers may monitor the work correspondence of employees and/or documents (files) created on technical (electronic) devices utilized by the employee to fulfill their job responsibilities," the draft states.
The document notes that monitoring work correspondence and/or documents (files) created on technical devices used by the employee to perform their duties is considered a last resort for employer control.
This monitoring can only be applied if alternative methods of supervising the employee's job performance are not feasible.
It is also mentioned that employers must inform employees about the implementation of monitoring and justify the objective necessity for its execution.
It is emphasized that this monitoring must not infringe upon the employee's right to privacy and family life.
Previously, there were discussions about new grounds for dismissal. TSN.ua has already reported on this and other potential changes in labor legislation.
